General Terms and Conditions

Effective Date: 25/05/2025

IMPORTANT

These General Terms and Conditions must be read together with the Vehicle Rental Contract, Booking Summary, Vehicle Condition Record, Privacy Policy, and any written addendum signed and confirmed by MJAT.

1. GENERAL TERMS AND CONTRACT DOCUMENTS

1.1 Application, Parties, and Scope
1.1.1

These General Terms and Conditions ("Terms") apply to every rental, booking, vehicle handover, vehicle use, return, payment, claim, and related service provided by MJ Adventure Travel Sdn. Bhd. ("MJAT", "we", "us", or "our").

1.1.2

The renter, customer, driver, authorised driver, company representative, or person whose particulars appear in the Vehicle Rental Contract, Booking Summary, or Driver Information segment is referred to as "Renter", "Driver", "You", or "Your".

1.1.3

These Terms are to be read together with the Vehicle Rental Contract, Booking Summary, Vehicle Condition Record, Privacy Policy, and any written addendum signed and confirmed by MJAT. Together, these documents form the agreement between MJAT and the Renter.

1.2 Order of Priority of Documents
1.2.1

If there is any inconsistency between the documents, the following order of priority applies: (i) any written addendum or variation signed or confirmed by MJAT after the date of the Contract; (ii) Vehicle Rental Contract; (iii) Booking Summary; (iv) Vehicle Condition Record; (v) these Terms; and (vi) any other policies referenced by MJAT, unless expressly stated otherwise in writing by MJAT.

1.3 MJAT's Right to Refuse or Cancel
1.3.1

MJAT may refuse, cancel, terminate, or recover the Vehicle where MJAT reasonably believes that the Renter has failed verification, provided false, inaccurate, or incomplete information, failed to make payment, breached the agreement, used or may use the Vehicle unlawfully, or presents a material safety, recovery, fraud, payment, insurance, or operational risk. Any Vehicle recovery will be carried out by lawful means.

1.4 Acknowledgement
1.4.1

By confirming a booking, paying any rental fee or deposit, collecting the Vehicle, signing physically or electronically, or using the Vehicle, You acknowledge that You have read, understood, and agreed to be bound by these Terms.

2. DEFINITIONS

2.1 Definitions
  • In these Terms and throughout the rental agreement, the following terms have the meanings set out below:
  • Authorised Driver means the Renter or any additional driver named and approved by MJAT in the Contract or in writing.
  • Booking Summary means the front page or booking page setting out the Vehicle, rental dates, charges, Security Deposit, Excess, pick-up location, drop-off location, and other booking particulars.
  • Covered Incident means an accident, collision, theft, or other loss that is covered under MJAT's applicable motor insurance or protection product, subject to policy terms, Excess, exclusions, and the Renter's compliance with the Contract.
  • Excluded Loss means any loss, damage, claim, cost, or liability that is excluded under the Contract, insurance policy, protection product, or these Terms, including breach, prohibited use, unauthorised driver, failure to report, or non-waivable items.
  • Excess" or "Accident Damage Excess means the maximum amount for which the Renter is liable per incident for covered damage or theft, as stated in the Booking Summary, subject always to exclusions, breach, prohibited use, and other separate charges.
  • Full-Pro" or "Full-Pro Protection Package means an optional excess-reduction product selected by the Renter. It is not comprehensive insurance and does not cover excluded items, prohibited use, breach of Contract, or any item stated as non-waivable.
  • Ordinary Wear and Tear means gradual deterioration of the Vehicle resulting from normal, authorised use, including minor surface marks and light tyre wear consistent with the Vehicle's age and mileage. It does not include scratches penetrating through paint, dents, stains, burns, chips, tears, broken components, damage to glass, tyres, rims, or lights, or any damage inconsistent with normal use.
  • Protection Product means CDW, TP, SCDW, Full-Pro, or any excess-reduction or protection package offered by MJAT.
  • Published Tariff means MJAT's published or notified schedule of charges, rates, administrative fees, fuel charges, cleaning charges, replacement costs, and other operational charges applicable to the rental.
  • Rental Period means the period from the Pick-up Date and time to the Drop-off Date and time stated in the Booking Summary, or such later time at which the Vehicle is actually returned and inspected by MJAT.
  • Restricted Territories means Sabah, Sarawak, Labuan, and any place outside Malaysia, together with any other place or route prohibited by MJAT.
  • Security Deposit means the refundable deposit paid by the Renter before vehicle collection, which MJAT may apply towards any amounts owed by the Renter under the Contract.
  • Vehicle means the motor vehicle described in the Contract, including its keys, accessories, registration documents, equipment, tools, spare tyre or repair kit, and any item supplied with the Vehicle.
  • Vehicle Rental Contract" or "Contract means the principal rental document signed or confirmed between the Renter and MJAT, setting out the Vehicle, driver information, Rental Period, charges, selected Protection Product, and other specific rental terms. Together with these Terms, the Booking Summary, the Vehicle Condition Record, and the Privacy Policy, it forms the complete agreement between MJAT and the Renter.
  • Vehicle Condition Record means any document, form, photograph, video, GPS-timestamped image, digital record, or inspection report used by MJAT to record the condition of the Vehicle at handover and/or return, as determined by MJAT from time to time.
  • Working Hours means MJAT's published office hours or such hours as MJAT may notify from time to time.

3. RENTAL QUALIFICATIONS AND REQUIRED DOCUMENTS

3.1 Rental Qualifications
3.1.1

The Renter must satisfy MJAT's rental requirements and verification checks before the Vehicle is released. MJAT may refuse handover or cancel the rental if the requirements in Clause 1.3.1 are not satisfied.

3.1.2

The Renter and any Authorised Driver must be at least twenty (20) years old and must hold a valid driving license with at least one (1) year of driving experience, unless MJAT approves a stricter or different requirement in writing.

  • 3.1.2A For Malaysian citizens, a valid Competent Driving License (CDL) and Probationary Driving License (PDL) are accepted.
  • 3.1.2B For international renters, a valid driving license issued by the renter's home country must be presented at vehicle collection. Where the driving license is not in the English or Malay language, the Renter must also present either (a) an International Driving Permit (IDP); or (b) a certified English or Malay translation endorsed by the relevant licensing authority or the issuing country's embassy in Malaysia. MJAT may impose additional requirements where required by MJAT's insurer. The 90-day driving entitlement under Malaysian law applies subject to the Renter's visa, immigration status, and the insurer's policy terms.
  • 3.1.2C A Renter or Authorised Driver who is under twenty-one (21) years of age or holds a Probationary (P) driving license is subject to the Compulsory Excess stated in Clause 12.4.
3.1.3

The Renter must provide all documents requested by MJAT, including identity card or passport, driving license, business card, student card, company authorisation letter, or other supporting documents where applicable.

3.1.4

Where the Renter rents on behalf of or represents a company, the individual Renter and the company shall be jointly and severally liable for all charges, losses, damage, claims, and obligations arising from the rental arrangement.

4. BOOKING, RENTAL PERIOD, CHARGES AND CANCELLATION

4.1 Rental Period and Charges
4.1.1

The Rental Period is determined by the Pick-up Date and time and Drop-off Date and time stated in the Booking Summary or booking confirmation.

4.1.2

Daily rental rates are based on twenty-four (24) hour periods from the start of the Rental Period. Additional hours and late return charges apply as stated in Clause 9.3.

4.1.3

All rates, charges, deposits, Excess amounts, penalties, and fees are quoted in Ringgit Malaysia (RM), unless expressly stated otherwise. Prices are inclusive or exclusive of applicable taxes only as stated in the Booking Summary, invoice, or receipt.

4.1.4

The Renter must settle all rental charges, deposits, delivery or collection charges, optional protection charges, and other amounts payable before or at vehicle collection, unless MJAT has agreed otherwise in writing.

4.2 Cancellation, No-Show, and Early Return
4.2.1

Cancellation charges apply as follows:

  • more than forty-eight (48) hours before the Pick-up Date and time: full refund, less any payment processing or transaction fee;
  • between twenty-four (24) and forty-eight (48) hours before the Pick-up Date and time: fifty percent (50%) refund;
  • less than twenty-four (24) hours before the Pick-up Date and time: no refund.
4.2.2

If the Renter fails to collect the Vehicle within two (2) hours of the booked Pick-up time without prior notice, the reservation may be treated as a NO-SHOW. The reservation may be cancelled or forfeited and no refund will be provided, unless otherwise agreed by MJAT in writing or required by applicable law.

4.2.3

If the Renter fails to provide all required documentation or fails MJAT's verification checks at vehicle collection, MJAT may refuse to release the Vehicle. No refund will be provided where the refusal is caused by the Renter's failure to provide required documents or satisfy verification, unless otherwise agreed by MJAT in writing or required by applicable law.

4.2.4

If the Renter returns the Vehicle earlier than the scheduled Drop-off Date and time, no partial or full refund will be given for unused rental time, unless otherwise agreed by MJAT in writing or required by applicable Malaysian law.

4.3 Extension of Rental
4.3.1

If the Renter wishes to extend the rental, the Renter must request the extension before the end of the Rental Period as stated in the Contract. The Renter is required to settle all necessary payments before the commencement of the extended period.

4.3.2

Any extension is subject to MJAT's written approval, Vehicle availability, insurance/protection availability, and advance payment of all extension charges. The rental is not extended unless MJAT confirms the extension in writing.

4.3.3

Unauthorised continued possession of the Vehicle after the agreed Drop-off Date and time will be treated as late return or non-return under Clauses 9.3 and 9.4.

5. PAYMENT, SECURITY DEPOSIT AND AUTHORITY TO CHARGE

5.1 Security Deposit
5.1.1

A Security Deposit in the amount stated in the Booking Summary must be paid before vehicle collection. The Security Deposit serves as security for all sums payable under the Contract and these Terms.

5.1.2

MJAT may deduct substantiated amounts from the Security Deposit for damage, Excess, late return, summonses, fines, parking, fuel, cleaning, missing items, keys, accessories, recovery, towing, storage, loss of use, administrative charges, or any other amount payable under the Contract. Deductions may be supported by the Vehicle Condition Record, photographs, videos, workshop quotation or invoice, insurer assessment, authority notice, Published Tariff, invoice, staff report, or other reasonable evidence.

5.1.3

The Security Deposit or any unutilised portion will be released within fourteen (14) days after the Vehicle is returned and final inspection is completed, subject to deductions and pending charges. Where deductions are made, MJAT will provide an itemised statement of deductions. The time taken for the refund to appear in the Renter's account depends on the Renter's bank or card issuer.

5.1.4

Refund or release of the Security Deposit does not waive MJAT's right to recover later-discovered charges, including summonses, fines, tolls, parking charges, damage, Excess, third-party claims, recovery costs, or any other amount arising from the Rental Period.

5.2 Currency and Payment Methods
5.2.1

All rental rates, charges, fees, deposits, and Excess amounts are quoted in Ringgit Malaysia (RM) and are inclusive or exclusive of applicable taxes (SST) only as expressly stated in the Booking Summary or invoice.

5.2.2

MJAT accepts major credit and debit cards, including Visa, Mastercard, UnionPay, or such other payment methods approved by MJAT. The payment card must be presented at vehicle pick-up unless MJAT approves another payment method in writing. The cardholder name must match the Renter's identity document, unless MJAT has specifically authorised or approved a third-party card for payment on the Renter's behalf. MJAT is not responsible for any misuse of a third-party card.

5.2.3

MJAT does NOT accept cash payments.

5.3 Consent for Full Authorisation of Cards
5.3.1

The Renter authorises MJAT to pre-authorise, charge, or debit the Renter's nominated payment card or payment method for all amounts payable under the Contract.

5.3.2

This authority includes post-rental charges discovered after the Vehicle is returned, provided such charges are supported by an invoice, Published Tariff, authority notice, Vehicle Condition Record, photograph, video, workshop quotation or invoice, insurer assessment, staff report, or other reasonable evidence.

5.3.3

If the payment method cannot be charged, MJAT may issue an invoice or payment demand, and the Renter must pay the outstanding amount within the period stated in the demand.

6. VEHICLE HANDOVER, DELIVERY AND VEHICLE CONDITION RECORD

6.1 MJAT's Warranty at Handover
6.1.1

To MJAT's knowledge and based on pre-rental inspection, the Vehicle is in roadworthy and serviceable condition at handover, subject to any condition recorded in the Vehicle Condition Record. The Vehicle is duly registered, has valid road tax displayed where required, and is covered by MJAT's motor insurance policy.

6.1.2

The Vehicle is supplied with its standard tools and accessories, including spare tyre or tyre repair kit, jack, wheel spanner, keys, and other items stated in the Vehicle Condition Record, where applicable and subject to availability for the Vehicle model.

6.2 Vehicle Condition Record and Pre-existing Damage
6.2.1

MJAT is responsible for regular maintenance and repairs not arising from the Renter's use, breach, negligence, prohibited use, accident, misfuelling, failure to notify, or other obligations under the Contract.

6.2.2

The Vehicle Condition Record, including written inspection notes, photographs, videos, fuel level, odometer reading, tools, accessories, and recorded damage, is evidence of the Vehicle's condition at handover and return.

6.2.3

If the Renter disagrees with the Vehicle Condition Record or wishes to report pre-existing damage not recorded, the Renter must notify MJAT by telephone or written message, including WhatsApp, WeChat, SMS, or email, within one (1) hour from the start of the Rental Period if collection occurs during Working Hours, or by 10:00 a.m. on the next Working Day where collection occurs outside Working Hours.

6.2.4

If no notice is received within the period stated above, the Vehicle is deemed to have been delivered in the condition shown in the Vehicle Condition Record and accepted by the Renter.

6.2.5

The Renter must immediately notify MJAT of any abnormality, warning light, breakdown, damage, defect, or incident arising during the Rental Period. Failure to notify MJAT or continued driving after a warning or defect may make the Renter liable for any resulting or aggravated damage.

6.3 Delivery, Collection, and After-Hours Return
6.3.1

Delivery and collection services are subject to availability, agreed location, timing, access, verification, and applicable charges. Charges may be calculated based on distance, timing, accessibility, waiting time, tolls, parking, and operational requirements.

6.3.2

If the Renter requests delivery, the Renter must be present at the agreed delivery location and time and must present original identification and a valid driving license. MJAT may refuse to release the Vehicle if the Renter is absent or verification is incomplete or unsatisfactory.

6.3.3

Any change to the agreed pick-up or drop-off location must be approved by MJAT in advance and may be subject to additional charges.

6.3.4

If the Vehicle is returned outside Working Hours, the Renter remains responsible for all charges, damage, loss, summonses, fuel, cleaning, and any other issue until MJAT has completed inspection upon resumption of Working Hours.

7. VEHICLE USE, RESPONSIBILITY AND PROHIBITED USE

7.1 Permitted Use
7.1.1

The Vehicle may be used only for personal use or routine business use and must be operated only on properly maintained public roads and lawful parking areas.

7.1.2

The Renter and every Authorised Driver must comply with all applicable road traffic laws, regulations, signs, parking rules, speed limits, and lawful directions issued by authorities.

7.1.3

The Renter must ensure the Vehicle is properly locked, secured, and parked in safe and lawful locations when not in use, and must take reasonable steps to prevent theft, loss, damage, or unauthorised access.

7.2 Prohibited Use
7.2.1

The Renter must not, and must not permit any other person to:

  • sublease the Vehicle, rent it to any person, use it as a vehicle for hire or reward, or transport persons or goods for commercial purposes without MJAT's written consent;
  • register, operate, or use the Vehicle on any ride-hailing, car-sharing, delivery, courier, or logistics platform, including but not limited to Grab, AirAsia Ride, GoJek, InDrive, Lalamove, GrabFood, or any other platform providing hire, ride, or delivery services for payment or reward, whether or not a formal fare is charged;
  • use the Vehicle for testing, towing, pushing other vehicles, racing, off-road activity, competition, rally, reliability trial, driving instruction, or any motorsport-related activity;
  • overload the Vehicle or carry passengers exceeding the Vehicle's permitted seating capacity;
  • permit any person other than the Renter or an Authorised Driver approved by MJAT to operate the Vehicle;
  • operate the Vehicle while under the influence of alcohol, drugs, narcotics, medication, fatigue, illness, or any condition that may impair driving ability;
  • continue driving after a puncture, flat tyre, warning light, overheating, abnormal noise, fluid leak, or unsafe condition, except where necessary to move the Vehicle to a safe location;
  • carry any item or substance that may discharge unpleasant odours, including but not limited to durian, mangosteen, strong-smelling food, pets, or similar items;
  • smoke, vape, or permit smoking or vaping in the Vehicle;
  • make structural modifications, alterations, or changes to the Vehicle, registration number, license plate, accessories, GPS/telematics device, or documents;
  • sell, rent, dispose of, pledge, charge, or grant any rights over the Vehicle or any of its parts, documents, tools, keys, or accessories;
  • use the Vehicle for any illegal activity, reckless driving, dangerous driving, or activity that may expose MJAT or third parties to loss, claim, penalty, or legal action.
7.3 Geographic Restrictions and Permitted Territories
7.3.1

The Vehicle may be operated only within Peninsular (West) Malaysia. The Vehicle must not be taken to Sabah, Sarawak, Labuan, Singapore, Thailand, Brunei, Indonesia, or any location outside Peninsular Malaysia without MJAT's prior written approval.

7.3.2

Langkawi ferry travel requires at least two (2) days' prior written notice to MJAT and MJAT's written confirmation of consent. No consent fee is charged, but prior confirmation is required for operational, insurance, and ferry-arrangement purposes.

7.3.3

Any travel outside the approved territory, or any ferry/cross-border travel without MJAT's written approval, may void or suspend protection benefits and makes the Renter liable for all loss, damage, recovery, towing, repatriation, claims, fines, penalties, and costs, subject to applicable law and the motor insurance policy.

8. FUEL, MILEAGE, TOLLS, SUMMONSES AND OPERATIONAL CHARGES

8.1 Fuel Policy
8.1.1

A Same-to-Same fuel policy applies. The Vehicle must be returned with the same fuel level recorded at the start of the Rental Period. If the Vehicle is returned with less fuel, MJAT may charge the fuel shortfall at the prevailing pump price at the nearest petrol station. No refund will be given if the Vehicle is returned with more fuel than recorded at collection.

8.1.2

If the Renter introduces the wrong type of fuel into the Vehicle, the Renter is fully liable for all draining, flushing, repair, towing, recovery, inspection, loss of use, and any resulting engine or mechanical damage. Misfuelling is not covered by CDW, SCDW, Full-Pro, or any other Protection Product unless MJAT expressly confirms otherwise in writing.

8.2 Mileage Restriction
8.2.1

The Vehicle is provided with unlimited mileage during the rental period, unless a mileage limit is stated in the Booking Summary. The Renter remains liable for any damage, loss, charge, or cost arising from reckless, negligent, unauthorised, or prohibited use of the Vehicle, regardless of mileage driven.

8.3 Summonses, Fines, and Traffic Offences
8.3.1

The Renter is responsible for all traffic violations, summonses, fines, penalties, compound notices, speed camera offences, and other traffic or regulatory offences incurred during the Rental Period.

8.3.2

Where MJAT receives any summons, fine, or notice in respect of the Vehicle during or after the Rental Period, the Renter shall reimburse MJAT the full amount together with an administrative processing fee of RM25 per summons or notice.

8.3.3

MJAT shall first deduct such amount from the Security Deposit. If the Security Deposit is unavailable or insufficient, MJAT shall notify the Renter and the Renter must settle the balance within two (2) Working Days. Failing payment, MJAT is authorised to charge the outstanding balance to the Renter's registered payment instrument.

8.3.4

The Renter's responsibility for summonses, fines, and notices applies for up to one (1) year after the end of the Rental Period for offences committed during the Rental Period.

8.3.5

The Renter must comply with all speed limits. Where MJAT receives speed alerts, telematics data, or evidence showing repeated or excessive speeding, MJAT may issue a warning, terminate the rental, recover the Vehicle by lawful means, and charge any resulting fines, penalties, recovery costs, damage, loss, or administrative fees permitted under the Contract.

8.4 Long-term Rental and Servicing
8.4.1

For long-term rentals, the Renter is obligated to bring the Vehicle to the MJAT office or an MJAT-approved workshop for scheduled maintenance at the intervals stated in the Vehicle's service schedule or as notified by MJAT in writing, whichever is earlier.

8.4.2

If the Renter fails to comply and continues driving more than five hundred (500) kilometres beyond the due service mileage or notified service threshold, MJAT may charge RM1.00 per excess kilometre as a reasonable maintenance-risk charge, subject to any cap stated in the Booking Summary or Published Tariff.

8.4.3

The Renter remains liable for any damage, breakdown, warranty loss, mechanical issue, or aggravated damage caused or contributed to by failure to make the Vehicle available for scheduled maintenance.

9. RETURN, LATE RETURN AND NON-RETURN

9.1 Responsibility for the return of the Vehicle
9.1.1

The Renter must return the Vehicle to MJAT on the date, time, and location stated in the Contract, in the same condition as at handover, fair wear and tear excepted. Any outstanding rental or other fees must be fully settled by the time the Vehicle is returned. Failure to settle these fees may result in additional penalties or charges as per the Contract.

9.2 After-Hours Return
9.2.1

If the Vehicle is returned outside Working Hours, the Renter remains responsible for all charges, damage, loss, theft, and condition of the Vehicle until MJAT completes inspection upon resumption of Working Hours.

9.3 Late Return
9.3.1

Late return charges are calculated as follows:

  • Grace period: up to fifty-nine (59) minutes after the scheduled Drop-off time, no additional rental charge;
  • From sixty (60) minutes up to five (5) hours late: half of the daily rental rate;
  • More than five (5) hours late: one (1) full day rental fee for that day; and
  • Each subsequent twenty-four (24) hour period or part thereof: one (1) full day rental fee for that period.
9.3.2

If the Vehicle is returned late without MJAT's prior written approval, rental Protection Products and protection benefits may be suspended or unavailable during the unauthorised late period. The Renter remains liable for late return charges and any damage, loss, theft, cost, claim, or liability occurring during that period, subject to the terms of the Vehicle's statutory motor insurance policy which cannot be contractually excluded.

9.4 Non-Return and Recovery Action
9.4.1

If the Renter fails to return the Vehicle by the agreed Drop-off Date and time, or within twenty-four (24) hours after written or oral demand by MJAT without response, the Renter may be deemed to be in unlawful possession of the Vehicle.

9.4.2

MJAT may take all lawful steps to locate and recover the Vehicle, including contacting the Renter, using GPS/telematics data, engaging recovery agents, notifying the police, lodging a police report, and commencing legal proceedings where appropriate. Any investigation, prosecution, warrant, or enforcement action is subject to applicable law and the authorities' discretion.

9.4.3

The Renter must cooperate with MJAT in any recovery action and is responsible for all reasonable recovery costs, towing, storage, administrative charges, legal costs where recoverable, and any damage or loss arising from the failure to return the Vehicle.

9.5 Force Majeure
9.5.1

In the event that the Renter fails to return the Vehicle during the rental period due to a natural disaster or any other force majeure event beyond the Renter's reasonable control, the Renter shall not be liable for damages arising solely from such event. In this case, the Renter shall immediately contact MJAT and follow the instructions given. For the avoidance of doubt, a force majeure event does not relieve the Renter from liability for any physical damage to the Vehicle occurring during or after the event, or from the obligation to return the Vehicle once the force majeure event has ceased.

9.6 Vehicle Inspection on Return
9.6.1

The Renter shall return the Vehicle in the same condition as when it was rented, except for ordinary wear and tear arising from normal use. Failing which, the Renter will be liable for the costs of restoring the Vehicle to its original condition.

9.6.2

When returning the Vehicle, the Renter shall, at their own responsibility, confirm that there are no items left behind in the Vehicle. MJAT has no obligation to inspect for, safeguard, or compensate for items left behind. Items recovered by MJAT will be stored for one (1) month from the date of recovery and may be disposed of without further notice or compensation if not collected within that period.

9.6.3

The Renter must promptly inform MJAT of any accident, damage, abnormality, defect, warning light, theft, breakdown, police matter, or other incident relating to the Vehicle.

9.7 Penalty Charges
9.7.1

The following charges apply where supported by inspection record, photographs, videos, staff report, third-party invoice, Published Tariff, or other reasonable evidence:

  • unpleasant odour, smoking, or vaping: RM200 to RM500 per incident, depending on severity;
  • extra cleaning, stains, food contamination, pet contamination, or remediation: RM100 to RM250 per incident, depending on severity;
  • lost or damaged key: actual replacement, programming, towing, and related costs, not waivable by any insurance or excess-reduction product; and
  • loss of rental days for cleaning or remediation: daily rental rate, capped at three (3) days.
9.7.2

MJAT may update operational charges in its Published Tariff, provided the applicable tariff is made reasonably available to the Renter at or before rental or before the charge is imposed.

10. BREAKDOWN, ACCIDENT, THEFT AND INCIDENT REPORTING

10.1 Measures in Case of Breakdown
10.1.1

If the Renter detects any abnormality, breakdown, warning light, puncture, mechanical issue, accident, or unsafe condition, the Renter must immediately stop using the Vehicle where safe to do so, contact MJAT, and follow MJAT's instructions. The Renter must not continue driving if doing so may aggravate damage or create safety risk.

10.1.2

MJAT provides complimentary roadside assistance for Vehicle problems not caused by the Renter. If the issue is caused or contributed to by the Renter, including running out of fuel, loss of keys, locked keys, wrong fuel, tyre damage, battery drain caused by misuse, or other avoidable issue, the Renter is responsible for roadside assistance costs and any parts, towing, or service charges.

10.1.3

Lost or damaged keys, immobilisers, access cards, or related items will be charged at actual replacement, programming, towing, and related costs, and are not waivable by any Protection Product.

10.1.4

The Renter must not allow anyone to service, tow, or repair the Vehicle without MJAT's prior permission, except where directed by police, emergency services, insurer, or lawful authority. If MJAT allows the Renter to carry out certain repairs, the Renter must obtain an original tax invoice and receipt from the repairer. MJAT will reimburse only authorised and verified repairs not caused by the Renter's breach, negligence, or prohibited use.

10.1.5

MJAT may, but is not obliged to, provide a replacement vehicle in the event of breakdown, accident, maintenance, or unavailability. No replacement vehicle will be provided where the issue arises from the Renter's breach, negligence, prohibited use, accident, late return, failure to report, or failure to cooperate, unless MJAT agrees otherwise.

10.2 Measures in Case of Accident and Theft
10.2.1

In the event of accident, collision, theft, fire, flood, damage, or any incident involving the Vehicle, the Renter must:

  • immediately notify MJAT and follow MJAT's instructions;
  • lodge a police report within twenty-four (24) hours of the incident or as soon as reasonably practicable where immediate reporting is not possible due to emergency, medical, safety, or authority-related reasons;
  • obtain details of all parties and vehicles involved, including names, phone numbers, registration numbers, identity particulars, insurer details, and photographs where safe and lawful;
  • not admit liability, settle privately, abandon the Vehicle, authorise repairs, or allow unauthorized towing without MJAT's prior approval, except where required by police, insurer, emergency services, or lawful authority;
  • refuse unauthorised tow-truck operators and use only tow or recovery arrangements approved by MJAT, the insurer, police, or lawful authority; and
  • cooperate fully with MJAT, the insurer, police, and any relevant authority in relation to investigation, claim, recovery, repair, or legal process.
10.2.2

Failure to lodge a police report within twenty-four (24) hours may invalidate or reduce protection benefits to the extent that MJAT's ability to make an insurance claim or recover costs is prejudiced by the failure to report. The Renter is liable for all costs, repairs, replacement, loss of use, and related charges that MJAT is unable to recover from the insurer due to the Renter's failure to report, cooperate, or comply with this clause.

10.2.3

If the Vehicle is stolen or cannot be located, the Renter must immediately notify the nearest police station and MJAT, and must provide all documents, statements, keys, information, and cooperation required by MJAT and the insurer.

11. DAMAGE, LOSS, COMPENSATION AND LOSS OF USE

11.1 Renter's Liability for Damage
11.1.1

The Renter is responsible for all damage, loss, or theft of the Vehicle occurring during the Rental Period, except to the extent caused solely by MJAT's pre-existing defect or Ordinary Wear and Tear.

11.1.2

Where the Renter has a valid Protection Product in force and has complied with all conditions of the Contract, the Renter's liability is limited to the applicable Excess amount as stated in the Booking Summary. Where no valid protection applies, or where an exclusion under Clause 12.3 applies, the Renter is liable for the full cost of repair, replacement, reinstatement, recovery, towing, storage, loss of use, diminution, third-party claims, legal/admin costs, and related charges.

11.1.3

If the Renter experiences any problems with the rental vehicle during the rental period, the Renter should inform MJAT's team immediately. Failure to inform MJAT of any damage or potential damage may result in major damage to the engine, transmission, and suspension, the cost of which will be the Renter's full responsibility.

11.1.4

MJAT may assess damage based on the Vehicle Condition Record, photographs, videos, staff inspection, workshop quotation, repair invoice, insurer assessment, expert assessment, Published Tariff, or other reasonable evidence. MJAT is not required to obtain the Renter's approval before carrying out repairs necessary to restore the Vehicle, preserve safety, comply with insurer requirements, or minimise loss.

11.2 Loss of Use
11.2.1

If MJAT is unable to use the Vehicle due to an accident, breakdown, damage, seizure, custody, investigation, repair, cleaning, odour treatment, or other incident attributable to the Renter, the Renter must pay loss of use at the daily rental rate for the actual period of unavailability, capped at thirty (30) days at the daily rental rate or the applicable Excess amount, whichever is greater, regardless of whether the Renter is at fault.

11.2.2

MJAT must not double-charge the Renter for the same loss of use under both this clause and the cleaning/remediation charge in Clause 9.7.

11.3 Vehicle Held Under Custody by Authorities
11.3.1

Without prejudice to any other charges, if the Vehicle is held under custody by the police, JPJ, customs, local authority, court, or any government authority due to any act, omission, breach, or event attributable to the Renter, the Renter shall be liable for:

  • one-time administrative and recovery fee of RM2,500, representing MJAT's estimated administrative, legal, and remediation costs for the first thirty (30) days of custody; and
  • loss of use at the daily rental rate for the entire period of custody, commencing from the first day the Vehicle is held under custody until the date on which it is released and available for rent.
11.3.2

MJAT will provide the Renter with a written statement of charges within a reasonable time. MJAT's right to recover actual losses exceeding these amounts is not affected.

11.4 Third-Party Liability and Indemnification
11.4.1

The Renter and/or any additional Authorised Driver are liable for third-party claims, loss, damage, personal injury, death, property damage, fines, penalties, or legal/admin costs arising from the Renter's use, breach, negligence, prohibited use, unauthorised driver, or operation of the Vehicle during the Rental Period, except to the extent covered by MJAT's applicable motor insurance and not excluded by the policy or Contract.

11.4.2

The Renter agrees to indemnify and hold MJAT harmless against all loss, liability, damage, claim, cost, and legal fees reasonably incurred due to the Renter's breach, negligence, prohibited use, unauthorised driver, failure to cooperate, or failure to comply with these Terms, subject to applicable law and the motor insurance policy.

12. INSURANCE, PROTECTION PACKAGES AND DAMAGE EXCESS

12.1 Insurance and Protection Overview
12.1.1

All MJAT vehicles are covered by valid motor insurance and the necessary road documentation. This insurance coverage applies only to damages or losses that exceed the Renter's Excess amount. The Renter remains liable for the initial Excess amount as specified in the Booking Summary.

12.1.2

The rental rate includes Collision Damage Waiver (CDW) and Theft Protection (TP) unless stated otherwise in the Booking Summary. CDW and TP are not comprehensive insurance and do not eliminate the Renter's liability.

12.1.3

CDW covers accidental damage to the Vehicle's body (including collision and single-vehicle accidents) up to the Vehicle's market value, subject to the Renter's Excess and all exclusions in Clause 12.3. CDW does not cover third-party property damage or personal injury, which are separately covered by the Vehicle's statutory third-party motor insurance.

12.1.4

TP covers theft of the entire Vehicle, subject to the Renter's Excess and all exclusions in Clause 12.3. TP does not cover theft of personal items left inside the Vehicle, theft of accessories, or theft of Vehicle parts.

12.1.5

Optional products such as SCDW or Full-Pro may reduce or waive the standard Excess only to the extent stated in the Booking Summary or Protection Product schedule. They remain subject to exclusions, prohibited use restrictions, timely reporting, police report requirements, Compulsory Excess, and non-waivable items.

12.1.6

Non-waivable items: tyres, rims, wheel caps, glass, mirrors, interior, keys, accessories, undercarriage, misfuelling, flood, illegal/prohibited use, unauthorised driver, late return, failure to report, and other items stated in the Contract or Protection Product terms.

12.2 Excess and Limit of Liability
12.2.1

For Covered Incidents where the Renter complies with the Contract, the Renter's liability for damage or theft of the Vehicle is limited to the applicable Excess stated in the Booking Summary, together with any non-waivable charges, Compulsory Excess, administrative charges, or costs stated in the Contract.

12.2.2

For Excluded Loss, breach, prohibited use, unauthorised driver, failure to report, failure to cooperate, misfuelling, late return, or non-return, the Renter may be liable for the full loss, repair, replacement, recovery, towing, storage, loss of use, third-party claims, legal/admin costs, and related costs.

12.2.3

The Excess cannot be waived or reduced unless the Renter has purchased SCDW, Full-Pro, or another Excess Reduction Product and has met all qualifying conditions for that product.

12.3 Insurance Exclusions
12.3.1

Notwithstanding any Protection Product purchased, the Renter remains fully liable for all costs (including the full value of the vehicle or third-party claims) in the following circumstances:

  • Failure to lodge a police report or cooperate with MJAT/insurer, to the extent MJAT's insurance claim, defence, or recovery rights are prejudiced.
  • Driving outside approved territory or outside Peninsular Malaysia without MJAT's prior written approval.
  • Loss or damage to keys, immobilisers, tools, accessories, documents, or vehicle items.
  • Damage to tyres, rims, and wheel caps, windscreen, glass, mirrors, interior upholstery, infotainment systems, accessories, or non-waivable items, except to the extent expressly covered by the selected Protection Product.
  • Undercarriage damage, unless directly caused by a covered collision, or the Renter can reasonably show that the damage was caused by a road defect or unavoidable road hazard on a properly maintained public road and the Renter promptly stopped driving and notified MJAT.
  • Flood, fire, landslide, riots, or natural disasters.
  • Intentional, reckless, negligent, illegal, or prohibited use.
  • Driving under the influence of alcohol, drugs, narcotics, medication, fatigue, illness, or impaired condition.
  • Unauthorised driver, overloading, racing, off-road use, towing, ride-hailing, delivery, courier, commercial use without approval, or any other prohibited use.
  • Misfuelling or use of wrong fuel.
  • Late return, non-return, failure to cooperate, or failure to take reasonable mitigation steps.
12.4 Compulsory Excess
12.4.1

An additional Compulsory Excess of RM400 per incident shall apply (in addition to the standard Excess) if the driver at the time of the incident: (a) is under twenty-one (21) years of age; (b) holds a Probationary (P) license; or (c) is not named as the Renter or an Authorised Driver in the Contract.

12.4.2

The additional Compulsory Excess does not permit use by an unauthorised driver and applies only where MJAT’s insurer or MJAT accepts the incident as a covered or partially covered incident despite the driver status.

13. CLAIMS, DEBT RECOVERY AND TERMINATION

13.1 Notification of Claims
13.1.1

Where an accident, damage, theft, loss, summonses, unpaid charges, or any claim arises, MJAT may notify the Renter by WhatsApp, phone call, SMS, email, letter, or any contact method provided by the Renter.

13.1.2

Where the Renter rents on behalf of a company or provides an emergency contact, the Renter authorises MJAT to contact such company or contact person for verification, payment, recovery, accident, non-return, emergency, insurance, or legal purposes, subject to applicable personal data laws.

13.2 Deposit Deductions and Settlement
13.2.1

If the Renter fails to respond or pay within the requested period, MJAT may deduct from the Security Deposit, charge the nominated payment card or payment method, issue invoices, send reminders, issue a formal Letter of Demand, appoint legal advisers or debt recovery agents, and commence legal action where appropriate.

13.3 Debt Recovery and Legal Action
13.3.1

Where permitted by law, MJAT may refer unpaid amounts, default, recovery matters, claim information, or relevant personal data to legal advisers, debt recovery agents, insurers, law enforcement, regulators, credit reporting agencies, or other relevant parties, subject to applicable legal and regulatory requirements.

13.3.2

The Renter shall reimburse MJAT for reasonable legal fees, debt recovery costs, administrative costs, towing, storage, repossession, investigation, and enforcement costs incurred due to the Renter's breach, non-payment, or failure to return the Vehicle.

13.4 Termination of Rental
13.4.1

MJAT may terminate the rental immediately, refuse to release the Vehicle, recover the Vehicle, or refuse future rentals if:

  • The Renter fails to make timely payment or settle any outstanding amount;
  • The Renter breaches the Vehicle Rental Contract, Booking Summary, Vehicle Condition Record, these Terms, or any written instruction by MJAT;
  • MJAT becomes aware of illegal activity, prohibited use, material misrepresentation, false document, suspected fraud, or conduct exposing MJAT or the Vehicle to risk;
  • The Renter fails to return the Vehicle, refuses inspection, fails to cooperate with a claim, or fails to respond to MJAT's reasonable request;
  • The Renter, being an individual, faces execution, insolvency, bankruptcy, or legal process affecting ability to pay; or the Renter, being a company, enters liquidation, receivership, winding-up, arrangement with creditors, or has an unsatisfied judgment.
13.4.2

Termination does not affect MJAT's right to recover charges, losses, damage, claims, penalties, legal costs, and other amounts incurred before or after termination.

14. PRIVACY, GPS TRACKING AND ELECTRONIC AGREEMENTS

14.1 GPS Tracking and Telematics
14.1.1

All MJAT rental vehicles are fitted with a Global Positioning System (GPS) tracking and telematics devices. By entering into a rental agreement with MJAT, the Renter acknowledges and consents to MJAT collecting, monitoring, recording, and retaining the Vehicle's location, speed, mileage, and operational data during the Rental Period for the following purposes:

  • Fleet management and operational efficiency;
  • Vehicle security and anti-theft tracking;
  • Accident or incident investigation;
  • Summons and traffic offence handling;
  • Enforcement of this Contract, including verification of geographical restrictions.
14.1.2

Such data may be disclosed to law enforcement authorities, insurers, or regulatory authorities where required by law or to protect MJAT's legitimate interests. MJAT processes telematics data in accordance with the Personal Data Protection Act 2010 (Malaysia) and MJAT's Privacy Policy.

14.2 Privacy, PDPA, and Personal Data
14.2.1

By booking, signing, paying, taking delivery, or using the Vehicle, the Renter consents to MJAT collecting and processing personal data, including identity documents, contact details, driving records, payment information, GPS/telematics data, accident information, and claim information, in accordance with Personal Data Protection Act 2010 (Malaysia) and MJAT's Privacy Policy.

14.2.2

Data is processed for identity verification, payment collection, fraud prevention, fleet security, GPS/telematics, summons handling, debt recovery, insurance, claims, legal compliance, and rental management. 14.2.3

The Renter may access, correct, or withdraw consent for data processing by emailing help@mjadventuretravel.com. Where the Renter withdraws consent for processing that is necessary for identity verification, payment, GPS tracking, security, claim, legal compliance, or operation of the rental, MJAT may be unable to continue providing the rental and may suspend or terminate the rental, subject to applicable law. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.

14.3 Electronic Agreements and Communications
14.3.1

In accordance with the Electronic Commerce Act 2006, the Renter acknowledges that an electronically accepted booking or signed digital contract is legally binding and carries the same weight as a physical paper document.

14.3.2

The Renter consents to the use of electronic signatures, electronic records, digital forms, online acceptance, WhatsApp/email communications, electronic payment authorisations, and electronic notices for the booking, rental, performance, enforcement, and record-keeping of the Contract.

15. GOVERNING LAW, DISPUTE RESOLUTION AND FINAL ACKNOWLEDGEMENT

15.1 Governing Law and Jurisdiction
15.1.1

These General Terms and Conditions and the Contract are governed by and construed in accordance with the laws of Malaysia.

15.1.2

The parties submit to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia, unless MJAT elects to commence proceedings in any other court of competent jurisdiction where permitted by law.

15.1.3

If any provision of this Contract is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.2 Dispute Resolution
15.2.1

Any dispute regarding charges, service quality, vehicle condition, performance, or any matter under the Contract must be submitted to MJAT in writing within fourteen (14) days after the end of the Rental Period, together with supporting evidence where available.

15.2.2

Disputes raised after this may not be entertained by MJAT and MJAT may rely on its records, inspection evidence, invoices, and authority notices, without prejudice to any statutory rights that cannot be excluded or limited under Malaysian law.

15.3 Final Acknowledgement
15.3.1

By signing the Contract, confirming a booking, making payment, taking delivery of the Vehicle, or using the Vehicle, the Renter acknowledges that they have read, understood, and agreed to the Contract, Booking Summary, these Terms, and any written addendum signed or confirmed by MJAT.

15.3.2

The Renter acknowledges acceptance of the Vehicle Condition Record, recorded fuel level, odometer reading, tools and accessories, selected Protection Product, Damage Excess, Security Deposit, charges, prohibited-use rules, accident reporting duties, GPS/PDPA notice, and MJAT's authority to deduct or charge amounts payable under the Contract.

15.3.3

The Renter authorises MJAT to charge their nominated payment card or payment method for all amounts due under this Contract, including post-rental charges supported by reasonable evidence, for which the Renter remains personally liable until fully paid.
